FBI REFERS HILLARY T0 DOJ FOR VIOLATIONS- but does not see criminal action

UPDATED AT BOTTOM

Today's Lesson: The behavioral difference between ""Extremely Careless" and Criminally Negligent is nothing. But in the courts it is the difference between freedom and jail.

This Holiday Weekend, the FBI interviewed Hillary Clinton in what is their penultimate step in determining if the criminal investigation will be prosecuited by them. The allegations are mishandling classified information. - Soren K.

From James Comey just Now:

  • Several thousand emails were not turned over to FBI
  • 110 emails contained classified info- FBI
  • 8 contained top secret info- FBI
  • Hillary used multiple servers- FBI

What they found

  1. WE DID NOT FIND CLEAR EVIDENCE OF INTENT BUT
  2. THERE IS EVIDENCE OF EXTREME CARELESSNESS IN THE HANDLING OF TOP SECRET INFORMATION
  3. ANY REASONABLE PERSON IN SEC CLINTON POSITION SHOULD HAVE KNOWN THAT THIS INFO SHOULD NOT BE ON UNCLASSIFIED PERSONEAL SERVERS
  4. Sec Clinton's personal email server was compromised by outside servers.
  5. it is possible that hostile haclkers obtained top secret info
  6. We looked at evidence being mishandled in either a grossly incompetent or intentional manner
  7. They do not believe criminal activity was apparent, but believe the former Secretary was acting in "extreme carelessness"
  8. THE FBI IS THEREFORE REFERRING THE CASE TO THE DOJ FOR PROSECUTION
    1. THEY SEE NO CRIMINAL ACTIVITY
    2. IT IS NOT THE FBI'S JOB TO PROSECUTE
    3. THE DOJ WILL DECIDE IF CLINTON'S "EXTREME CARELESSNESS" FROM A" PERSON WHO SHOULD HAVE KNOWN THIS INFO SHOULD NOT BE ON UNCLASSIFIED PERSONAL SERVERS" MERITS PROSECUTION+

UPDATE

For the Record: Less than a yr ago, FBI sentenced a Naval reservist for "unauthorized removal & retention of classified materials"- FBI Sacramento

SACRAMENTO, CA 7/15/2015—Bryan H. Nishimura, 50, of Folsom, pleaded guilty today to unauthorized removal and retention of classified materials, United States Attorney Benjamin B. Wagner announced.

Nishimura’s actions came to light in early 2012, when he admitted to Naval personnel that he had handled classified materials inappropriately. Nishimura later admitted that, following his statement to Naval personnel, he destroyed a large quantity of classified materials he had maintained in his home. Despite that, when the Federal Bureau of Investigation searched Nishimura’s home in May 2012, agents recovered numerous classified materials in digital and hard copy forms. The investigation did not reveal evidence that Nishimura intended to distribute classified information to unauthorized personnel.
